This Privacy Notice explains how Ed's Garden Maintenance Ltd (trading as Ed's Garden Services), Thames Ditton and Esher Golf Club, Portsmouth Road, Esher, Surrey, KT10 9AL, United Kingdom, its local Business Owners and Ed's Group Limited, collect and use your personal data when you ask us about, or receive, our gardening services or use our website (edsgardenservices.co.uk). Ed's Garden Maintenance Ltd is registered in England (company number 05821537).

We process your personal data on one or more of the following legal bases: to perform our contract with you (for example, to carry out and invoice the gardening services you request); for our legitimate interests in running, protecting and improving our business; to comply with our legal obligations; and, where required, with your consent (for example, for certain marketing or cookies). Where we rely on consent, you can withdraw it at any time. We may update this Notice from time to time; we will post the current version on this page and, where changes are material, take reasonable steps to bring them to your attention.

How Ed's is structured and who controls your data

Ed's services in your area are provided by a local Business Owner who runs their own independent business under the Ed's brand. Depending on how you contact us, your personal data is collected either by Ed's Garden Maintenance Ltd (for example, when you make an enquiry or booking through the Ed's website or call centre) or directly by your local Business Owner (for example, when you deal with them in person). In each case your data is shared between Ed's Garden Maintenance Ltd and your local Business Owner so that your service can be arranged and delivered.

Your local Business Owner and Ed's Garden Maintenance Ltd each act as separate, independent controllers of your personal data. This means each decides how it uses your data for its own purposes — for example, your Business Owner to deliver your service, and Ed's Garden Maintenance Ltd to manage the network, handle enquiries and maintain service quality. Ed's Group Limited owns the Ed's brand and system but does not routinely use your personal data; it may receive your data only where necessary, for example to keep your service running if arrangements within the Ed's network change.

If your local Business Owner changes, your personal data may be transferred to a replacement Business Owner so that your service can continue without interruption.

We will collect and process the following personal information about you:

  • • Details of the services you request, your appointments, and the work carried out at your property.
  • • Payment and billing information.
  • • Your contact history with us and your local Business Owner.

2. How We Use Your Information

We use your personal data for the purposes below. The legal basis we rely on for each purpose is shown alongside it.

  • • Providing, scheduling and carrying out the gardening services you request — to perform our contract with you.
  • • Taking payment and keeping financial and tax records — to perform our contract and to comply with our legal obligations.
  • • Managing your account, enquiries and customer support, and routing your work to your local Business Owner — legitimate interests and contract.
  • • Improving our services, quality monitoring, feedback and testimonials — legitimate interests (and consent where a testimonial identifies you).
  • • Protecting our business, preventing fraud and resolving disputes — legitimate interests.
  • • Marketing relevant Ed's gardening services to you — where you have enquired about or used our services, we rely on our legitimate interests (and the “soft opt-in” under PECR) to send you occasional updates about our own similar services. You can opt out at any time, using the unsubscribe link in any message or by contacting us.

If we want to use your information for any other purpose, we will ask you for explicit consent and will use your information only upon receiving your confirmation, and then, solely for the purpose for which it was granted unless required otherwise by law.

3. How We Share Your Information

We share your personal data only as described below. We do not sell your personal data.

  • Your local Ed's Business Owner, and any replacement Business Owner, so your service can be delivered.
  • Ed's Garden Maintenance Ltd and Ed's Group Limited, as separate controllers, to manage the Ed's network.
  • Our call centre and IT / software providers who process data on our behalf as our processors.
  • Payment providers, to take and process payment.
  • Professional advisers, insurers, or public authorities where necessary or required by law.
  • Third-party marketing or advertising partners only where you have given any consent required; you can opt out at any time.

We require such third parties to use the personal information we transfer to them only for the purpose for which it was transferred and not to retain it for longer than is required for fulfilling the said purpose.

We may also disclose your personal information to satisfy applicable law, regulation, court order, or other ongoing legal processes; to enforce your agreements with us; or to respond to claims that your use of the Service violates any third-party rights.

4. Retention Of Your Information

We keep your personal data only for as long as we need it for the purposes set out in this Notice. In general: we keep customer and service records while you are an active customer and for a reasonable period afterwards to handle queries, warranty and repeat business; we keep financial and tax records for the period required by law (usually six years); and we keep marketing data until you opt out. When we no longer need your data, we securely delete or anonymise it. Residual anonymous information and aggregate information, neither of which identifies you, may be stored indefinitely.

Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, and a right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk and such other rights as may be relevant under applicable laws.
